PETITION FOR INTRODUCTION OF LOCAL LAW TO NASSAU COUNTY LEGISLATURE

 

Pursuant to ARTICLE 1-A, Section 150-a (3) of the Charter of Nassau County, the following proposed local law is hereby introduced by qualified electors of Nassau County.

 

I, the undersigned, do hereby state that I am a duly enrolled voter of Nassau County and entitled to vote at the next general election; that my place of residence is truly stated opposite my signature hereto, and I do hereby submit the proposed ordinance as noted below.

 

THE PROPERTY TAX REDUCTION LAW

 

A proposed local law relating to changes in budget, and tax levies; creating and adding new sub-sections to the Charter of Nassau County ARTICLE 3, Section 305 and 306.

LEGISLATIVE INTENT

 

New Sub-Section.     1.    The Property Tax Reduction Law would provide immediate relief to all residents of Nassau County who pay property taxes.

This measure would reduce property tax levies for Nassau County by 10% beginning in 2008. This would be based on budgetary reductions and offsets resulting in higher than anticipated tax revenues. This measure would not affect voter approved levies. While all taxing jurisdictions claim their percentage of taxation in of itself is reasonable, the cumulative effect of taxation by all taxing jurisdictions has resulted in the highest rate of property taxes in the nation.

 

DECREASING THE PROPERTY TAX BURDEN BY REDUCING REGULAR PROPERTY TAX LEVIES FOR NASSAU COUNTY BY 10%.

 

New Sub-Section.     2.     A new section is added to ARTICLE 3, Section 305 and 306 to read as follows:

 

(1) The regular property tax levy for Nassau County shall be reduced by 10.0 percent of the levy amount that would otherwise be allowed under this Article without regard to this section beginning with taxes levied for collection in 2008 and every year thereafter.

(2) Before applying the reduction in the property tax levy required by this section, levies shall be set every year at the amount that would otherwise be allowed under this Article without regard to the prior years’ reductions provided for in this section.

 

CONSTRUCTION CLAUSE

 

New Sub-Section.     3.     The provisions of this law are to be liberally construed to effectuate the policies, purposes, and intent of this law.

 

SEVERABILITY CLAUSE

 

New Sub-Section      4.    If any provision of this law, or its application to any person or circumstance or contract, including bonds, is held unconstitutional or invalid, the constitutionality or validity of the remainder of the law or the application of the provision to the persons or circumstances shall not be affected. If the reduction of property tax revenue in this law is judicially held to impair any Nassau County contract in existence as of the effective date of this law, any property tax revenue not pledged to that contract shall be reduced as provided in sub-section 2. The reduction of property tax revenue shall apply notwithstanding any other or subsequent contract, including novation, renewal, or refunding (in the case of bond contract). The reduction of property tax revenue shall take effect as soon as any contract in existence as of the effective date of this law is no longer held to be impaired.
