Comptroller Hevesi Watch

December 22, 2006

Alan Hevesi resigned today as Comptroller and plead guilty to a class E felony for stealing state funds. Mr. Hevesi acknowledged that he never intended to repay the money.  The New York state legislature will meet to pick his successor.

December 12, 2006

The Attorney General's Office announced that Mr. Hevesi agreed to repay the state $206,293.71 for the use of state employees who performed non-official duties for his wife. The report noted that Mr. Hevesi used four state employees for non-official duties and failed to keep accurate records. The actual amount was calculated by using various other information sources.    

November 25, 2006

The Albany District Attorney has expanded his criminal probe of Alan Hevesi to include allegations involving his Chief of Staff Jack Chartier. The DA is investigating allegations that Mr. Chartier provided a state driver on a regular basis to chauffer actress Peggy Lipton.  

November 20, 2006

Governor Pataki signed an executive order giving David Kelly subpoena power in his ongoing investigation of Mr. Hevesi. As Mr. Hevesi was re-elected, any effort to remove him at this time will only apply to his current term which ends December 31, 2006. It would appear that any effort to remove him from office must be initiated after January 2007.

November 4, 2006

The AP reported that David Kelly determined that there is enough evidence to remove Hevesi from office, however he declined to make a recommendation for removal. He did so as he was not certain which legal standard the Senate would use, preponderance of evidence or beyond a reasonable doubt, the latter a standard in criminal trials. He has indicated that the preponderance of evidence shows Mr. Hevesi "knowingly and intentionally violated New York's public officers law."

October 27, 2006

Today Governor George Pataki appointed former U.S. attorney David Kelley as a special counsel in the Hevesi matter. Mr. Kelley will review all of the investigative material and the Ethics Commission's report and will make a recommendation to the Governor as to whether Mr. Hevesi should be removed from office. The Governor has indicated that he will decide how to proceed based on Mr. Kelley's recommendation. His report is expected to be completed in seven days.  

October 24, 2006

Comptroller Hevesi asked to resign

Today, the Nassau County Civic Association, Inc. has called for the resignation of NYS Comptroller Alan Hevesi. The Ethics Commission Report  left no doubt that Hevesi violated the public trust and cannot effectively continue. The NCCA also contacted the Albany County DA and requested that they take the lead in the criminal investigation of Hevesi's actions. We believe that AG Eliot Spitzer cannot conduct an impartial investigation as he endorsed Hevesi and has failed to immediately initiate an investigation of his conduct. Members of the legislature were contacted with the request that an inquiry be conducted to determine if Hevesi should be removed from office as he has refused to resign. We would ask that everyone who supports open, honest and moral government to contact your state Senator and Assembly member to demand that the legislature act.
