New York's top court strikes down local laws restricting residence of sex offenders
In a surprise move, the Court of Appeals struck down a local residency law passed in Nassau County that prohibited a registered sex offender from residing within a 1000 feet of a school or playground. The court ruled that Nassau's local law is superseded by the state law. The state law however only covers lever 3 sex offenders not levels 1 & 2.

Governor Spitzer signs civil confinement bill on March 14
March 6 Today the NYS Assembly passed Assembly Bill 6162 which provides for civil commitment of sexual predators. The bill which already passed in the Senate now goes to the Governor for his signature. The law would allow the Attorney General to seek civil confinement of sexual predators who complete their prison sentence and are deemed a danger to society by jury trial. The Assembly also passed Assembly Bill 2012 which clarifies state law pertaining to disseminating indecent materials to minors. This would allow the prosecution of those that send written descriptions or depictions of nudity to a child by computer to solicit children for sex. The Assembly is also considering additional legislation to address sexual predators. We would like to thank Speaker Silver, members of the Assembly and Senate for passage of this critical legislation.

ACTION ALERT: Tomorrow the NYS Legislature goes into special session to consider several pieces of legislation including passage of a civil confinement bill for sexual predators. The Senate passed a strong bill but the Assembly bill is insufficient. Please contact Assembly Speaker Silver at 212-312-1420 or 518-455-3791 and urge passage of a strong civil confinement law.
Unfortunately, the legislature is also poised to raise their salaries for their part time job.
UPDATE December 18, 2006: The session produced no results. Speaker Silver indicated that he will bring the Civil confinement bill up for a vote in January when the legislature reconvenes.
