Looking to Tax You More: Cuomo Seeks to Tax Internet Sales

Due to a recent US Supreme Court case which held that states can now collect sales tax on internet sales, Governor Cuomo is seeking to impose sales taxes on New York residents for all internet sales. This comes on top of all of the fee hikes and taxes hikes already contained in his proposed budget. Click here for the story

Cuomo Announces Budget Short Fall, Looks to Roll Back Tax Cut for Middle Class

Instead of understanding why New York has a budget short fall in the pending budget for 2019, the Governor is trying to blame the Tax Reform law. When New Yorkers identified a benefit to prepay property taxes early in order to get the full benefit of the 2017 SALT deduction before it was capped at $10,000 in 2018, many took advantage. As a result, NY tax revenues surged. Now that there is a drop in the tax revenue, why is the Governor taken by surprise? Coupled together with the excess taxation and spending imposed by his own administration, he needs to look no further than his own mirror. Instead of taking it out on the middle class, maybe he could cut the $27 million allocated to give illegal aliens free education as well as other wasteful spending. After all, that is the least he can do.

More Albany Priorities

 

New York State legislators approve a $420 million dollar film tax credit for Hollywood and the Tonight Show but took no action on a cancer tax credit for those who are afflicted with cancer. One Senator's office explained that they need to find a way to pay for the latter. Apparently they had no problem giving your money to Hollywood. E.J. McMahon of the Empire Center questioned the economic benefit, "They produce no lasting economic benefit. The most these movies provide in out of the way places like Rochester and Albany is a few days of temporary business for caterers and the like while tying up the streets.”

Albany Strikes Again

 

At a time when families are struggling to make ends meet and find a way to pay for their child's college education, New York legislators are getting ready to help. The problem is who they want to help. Instead of using common sense, Assembly Leader Shelly Silver and his Democrat majority are pushing a bill, "The Dream Act"  that would make state financial aid available to illegal aliens. So instead of making it easier for the middle class to  compete for scarce state financial aid, taxpayers must share their hard earned money with those who pay nothing and who by their very nature refuse to live by the rules. Told you so! New York State deep in the red

 

New York Comptroller Thomas Di Napoli revealed that New York Public authorities which now number 1169 have accumulated almost $250 billion in public debt. That does not include the state debt of $63.9 billion. The NY Post reported this past January that New York has the highest debt out of the fifty states and twice the national average. The NCCA has written several articles on this issue and has urged our elected officials to act. Instead of acting, the state increased the number of public authorities by 160 and increased the off balance sheet debt.

Senator calls for national legalization of Marijuana

Senator Leahy who is the Chairman of the Senate Judiciary Committee has called for the legalization of up to one ounce of Marijuana and will hold a hearing in January. This comes after the President comments that he would not make enforcement an a priority in the two states which recently legalized the use of the drug. Click here for the story. 

Cuomo; Legalizing Pot is doing the People's business

Governor Cuomo outlined his priorities for the coming year by including the decriminalization of small amounts of marijuana. He described the initiative as doing "the People's business" and that he will fight against those in the legislature who oppose his efforts. Click here for the story.

More stimulus: Governor to give felons free healthcare

In a bizarre move, Governor Cuomo's Department of Health is moving forward on an initiative to sign up thousands of convicted felons for Medicaid, the state run medical plan. While tens of thousands of middle class families struggle under the tremendous tax burden of the vampire state, the Governor is focused on furthering a narrow ideological agenda. This initiative is no different then his decision to eliminate the finger imaging requirement for food stamp recipients that reduced fraud. New York has a spending problem not a revenue problem. How does this policy help the middle class?

Judge does what Governor and legislature didn't do; cut taxes

 

Late last week, Nassau County Supreme Court Judge Bruce Cousins ruled that the much hated MTA payroll tax was unconstitutional. The judge found that the law required a home rule message from the affected counties or a message of necessity which requires a two thirds vote of the legislature. The law which was upheld by three other courts now moves to the appellate court. The Mangano administration hailed the ruling as a victory for taxpayers. The state vowed to appeal. While the Governor and the legislature passed legislation earlier this year that slightly reduced the amount of the tax, the $1.8 billion tax remains like a weight around the neck of taxpayers as it effects the cost of vehicle registrations, the cost to rent a car and the cost to do business in the state due to the payroll tax.

Governor gives second State of the Union address, nothing new

 

The Governor declared, "I believe this state is at a crossroads, what we do today will determine the course of this state for decades to come." In his first year, he did what was expected, he passed a budget on time, made some cuts, enacted a wage freeze but did nothing to address the structural fiscal crisis facing the state for the next decade. What he did talk about was spending more money on education, Medicaid and on public projects. Where is his consolidation plan for State government? The number one problem is government spending. Again the Governor is ignoring the problem. With a failed leadership in the Assembly and the Senate, it's nothing new. It's Albany.

Total State Debt = $4 Trillion

 

The total debt for fifty states including their pension liabilities is more then $4.2 trillion. California which has the largest population in the United States is number one, New York comes in second with $305 billion in debt. While Governor Cuomo has made headlines by passing a  timely state budget, he has done nothing to eliminate off balance sheet transactions or what we call Public Authorities.

Governor Cuomo Accepts Recommendations from the Medicaid Redesign Team

Governor Andrew M. Cuomo today accepted a report from the Medicaid Redesign Team which meets the Governor's Medicaid spending target contained in his 2011-2012 budget by introducing a global cap on State Medicaid expenditures of $15.109 billion. The report included 79 recommendations to redesign and restructure the Medicaid program to be more efficient and get better results for patients.

During an appearance with Fred Dicker's Talk 1300 AM Radio Show, Governor Cuomo sounded more like a spokesman for the Tea party, “There is a difference between supporting the bureaucracy of education and funding and enhancing performance for the students — they’re not always synonymous,” Cuomo said. ” … If you give more money to the education system, that’s better for the students. Really? Or is it better for the bureaucracy of education? … How many times have your heard about additional performance measures, graduation rates, student achievement rates? NY Accounts for 29% of all State Tax Hikes in the U.S. Since 2009

From NY Fiscal Watch; "New York’s per-capita state tax hikes over the past two years will come to $414 per capita  far more than any state including California, which has raised taxes by $312 per capita, according to this estimate. In fact, New York alone accounts for fully 29 percent of all the state tax increases proposed and enacted since 2009.   This may qualify New York politicians for yet another dubious achievement award."

New York has the worst Business Tax Climate in America

According to a report from the Tax Foundation, a research group, New York State has the worst business climate in America due to its excessive taxes on business, personal income and high property taxes.

New York and New Jersey have the highest property taxes in America

Last month the Census Bureau released new data showing that homeowners in the Northeast pay the most highest property taxes and in particular, New York and New Jersey pay the highest property taxes in America.

Albany declares war on Taxpayers

File this under Incredible---The NYS Senate by a 56-2 vote passed a bill that would punish taxpayers who vote NO for their local school budget. When voters reject their local school budget, the district can decide to have another vote or enact a Contingency budget. Usually the Contingency budget is lower that the proposed budget. The new bill will allow Contingency Budgets to go even higher than the proposed budgets. Instead of allowing the law as it existed to take effect and restrict a CB ("austerity budget") to reflect inflation and go down by -0.4%, the NYS Senate will now allow a defeated budget to go up by +3.07%.

ALBANY -- Worried about a potential wave of "no" votes for upcoming school budgets, the Senate has passed legislation that would make it easier for districts to increase their budgets even if voters shoot down spending plans.

Business owner files suit to rescind MTA Payroll Tax

On December 14th, business owner William Schoolman filed suit against the state of New York  asserting that the MTA employer payroll tax was illegal as it violates the New York state constitution. Mr. Schoolman is the owner of Hampton Luxury Liner (Hampton Transportation Ventures, Inc.) and Schoolman Transportation System in Bohemia, NY. The lawsuit filed in Suffolk county seeks to have the law declared unconstitutional and a refund of the more then 1.35 billion collected to date.  We would like to thank Mr. Schoolman for standing up for New York business owners.

LI Senators provide critical votes for MTA bailout funded by new taxes

Senator Craig Johnson (D-Port Washington) and Senator Brian Foley (D-Brookhaven) voted in favor of the MTA bailout plan which passed 32-30. The legislation which was signed by the Governor will cost local taxpayers millions in higher taxes and fees.

LI Senators to provide critical votes for MTA bailout funded by new taxes

Senator Craig Johnson (D-Port Washington) and Senator Brian Foley (D-Brookhaven) have announced their support for the MTA bailout plan. The center piece of the plan calls for a payroll tax reminiscent of the commuter tax, however it is distinctly different as it limited to twelve counties and will be paid by employers. The new tax will be 34 cents per $100 of payroll. Putnam, Dutchess & Orange counties will pay a reduced tax of 25 cents per $100 in payroll. The legislation also  includes an additional surcharge on driver licenses/permits and increased vehicle registration fees. In an effort to blunt the cost to local school districts, the state agreed to provide an additional $60 million in funding to schools, however like everything else in Albany, the funding is not guaranteed. The cost of the payroll tax will be passed along to taxpayers by their employers and through governmental agencies via higher local taxes. As one vote separates passage of the tax laden bailout plan (there is no Lt Governor to break a tie), either Senators can kill the plan. Unfortunately for Nassau and Suffolk taxpayers, both will vote against their constituents and with the Governor.

New York Legislature poised to pass ground breaking $8 billion tax increase

Governor Patterson and legislative leaders, Shelly Silver and Malcolm Smith have reached agreement on the 2009-10 state budget. The agreement calls for a 9% increase in state spending and more then $8 billion in taxes and fees. The proposed tax increase would actually double the $4.6 billion that the Governor initially proposed. Spending will rise to almost $10 billion which is more then ten times what the Governor initially proposed. Say NO to Governor Patterson's $4.2 Billion tax increase!

On December 16th, Governor Patterson proposed the largest tax increase in New York State history taxing everything from IPod uploads to gasoline. Enough is enough. First Nassau County then each of the three towns, LIPA and now New York State. The MTA is pushing for a payroll tax which is supported by the Governor. In light of our current economic situation, common sense would call for spending cuts not tax increases. The proposed state budget actually calls for $1.4 billion in new spending. It's obvious that the Governor is either out of touch or just doesn't get it. Let him know what you think.

Decision expected in taxpayer lawsuit against corporate welfare

In August, more then fifty plaintiffs joined a lawsuit to end the State's practice of providing cash grants to corporations for economic development. Their complaint is based on NY's Constitution which states;  “The money of the state shall not be given or loaned to or in aid of any private corporation or association, or private undertaking; nor shall the credit of the state be given or loaned to or in aid of any individual, or public or private corporation or association, or private undertaking. . . “ A decision is expected shortly.
