The NCCA is calling on President Trump to invoke the Insurrection Act to Federalize the National Guard to use along with Military units to quell the insurrection in New York City. Gov Cuomo & Mayor De Blasio Argue as NY Burns 

In a bizarre rambling diatribe, Governor Andrew Cuomo blamed the NYPD and the Mayor for failing to quell the violence and looting in NYC, "It was a disgrace..., “The NYPD and the mayor did not do their job last night." He went on to say that “The police in New York City were not effective in doing their job last night. Period." He then went on the say that he could displace the Mayor and has the power to deploy thirteen thousand national guard members but won't. He then went on to say, “It is a bizarre thing to try to do in this situation,” How is it bizare to protect people from violence when your the Governor?? The question is simple, the Governor who has the power to send in the National Guard, the State Police and or other state law enforcement has done nothing but play the blame game. Quite disgraceful and a failure of leadership.

Andrew Cuomo the Criminal's Friend Strikes Again

In the darkness of night and hidden in the state's April Budget agreement, Governor Andrew Cuomo signed a provision of the budget agreement which makes it a class E Felony for police to share DMV information with the Department of Homeland Security and Immigration & Customs Enforcement. Putting criminals first is shameful. It is an act of a coward who is willfully ignoring the lessons of 911 which cost thousands of New Yorkers their life. Reform of "Bail Reform" a Flop

In another slight of hand, the Governor Cuomo added changes to the disastrous bail reform passed last year that resulted in the release of violent criminals on the streets of New York. The so called changes enacted through another rushed budget bill still allow for the release of career criminals who commit acts of violence. The changes add some offenses to the list of bail eligible crimes and gives some limited discretion to judges for those crimes, however it still allows for the wholesale release of those charged with serious offenses. Only in the bubble of Albany does this make any sense.

Governor Cuomo, "The bail reform that we did last year, I'm very proud of because (the previous system) was discriminatory in effect and in impact," he said. "I think we made the right change now and I think the improvements we've made this year are the right ones also." Click here to see the budget law. Really Governor, some of the additonal crimes added to the list of eligible offenses:

*Any crime alleged to have caused a death
*Promoting an obscene sexual performance by a child
*First-degree grand larceny
*Failure to register as a third-degree sex offender
*Second-degree burglary if someone enters the living area of a home
*Escape from Custody

More for New York's Criminals

In another effort to reward criminals, the New York Legislature is considering several bills to help convicted criminals. One bill requires that any inmate who is 55 years or older who has served at least fifteen years of their sentence to eligible for Parole regardless of the crime they were convicted of. That would include homicide, rape, robbery and any other violent crime.  To read more ........

A Criminal's Friend; Andrew Cuomo and NY Legislature

In a calculated and reckless move putting criminals first, Governor Cuomo and the Democrat controlled New York Legislature eliminated the requirement of bail for so called non-violent crimes. The change was enacted this past June during the end of the legislative session and took effect the first of this month. The new law eliminates the ability of judges to use their discretion to decline bail to those individuals who are charged with serious offenses who are deemed a danger to the public. The law as written mandates the immediate release of those charged with a host of serious crimes. The Governor estimated the new law will keep over 90% of those accused out of jail. NY Police to Treat Drug Overdose Sites as Crime Scenes to Target Dealers


Taking the initiative, Erie County law enforcement officials will now process drug overdose scenes for evidence in an effort to identify the trail of the drugs and to identify the source for prosecution. In light to the Heroin epidemic and its deadly consequences, it is a wise strategy.

Governor Spitzer signs civil confinement bill on March 14

March 6 Today the NYS Assembly passed Assembly Bill 6162 which provides for civil commitment of sexual predators. The bill which already passed in the Senate now goes to the Governor for his signature. The law would allow the Attorney General to seek civil confinement of sexual predators who complete their prison sentence and are deemed a danger to society by jury trial. The Assembly also passed Assembly Bill 2012 which clarifies state law pertaining to disseminating indecent materials to minors. This would allow the prosecution of those that send written descriptions or depictions of nudity to a child by computer to solicit children for sex.  The Assembly is also considering additional legislation to address sexual predators. We would like to thank Speaker Silver,  members of the Assembly and Senate for passage of this critical legislation.

ACTION ALERT: Tomorrow the NYS Legislature goes into special session to consider several pieces of legislation including passage of a civil confinement bill for sexual predators. The Senate passed a strong bill but the Assembly bill is insufficient. Please contact Assembly Speaker Silver at 212-312-1420 or 518-455-3791 and urge passage of a strong civil confinement law.

Unfortunately, the legislature is also poised to raise their salaries for their part time job. 

UPDATE December 18, 2006: The session produced no results. Speaker Silver indicated that he will bring the Civil confinement bill up for a vote in January when the legislature reconvenes.
