Immigration Anarchy 

President refuses to enforce  federal law

In a widely anticipated ruling, the US Supreme Court ruled today that the state of Arizona has the right to inquire about the immigration status of those who are lawfully stopped by the Police. The Arizona law known as SB 70 was intended to address the illegal immigration crisis facing the border state. Three other provisions of the law were invalidated as the court found that the law intruded on federalism, the supremacy of the federal government's role in enforcing the nation's immigration laws.

 

The common sense victory was short lived as the Department of Homeland Security under the direction of the President announced plans for immediately decertify Arizona Law Enforcement agencies who were certified to enforce immigration law under the 287g program. DHS was also directed to disregard calls from Arizona Police when illegal immigrants are taken into custody unless they are charged with or convicted of certain felonies. This comes on top of the President's move to refuse to detain over one million illegal aliens who are deemed to have entered the United States as children under the age of 16 years old and who are under the age of 30. DHS memo claims prosecutorial discretion is a public declaration in defiance of existing federal law in which the exercise of discretion  was removed.

 

The President has made it clear that if he as the executive branch disagrees with a law passed by Congress, he will simply circumvent it by any means necessary. His action is a violation of the separation of powers and is an abdication of his oath of office. The President's willful refusal to enforce existing federal law undermines our system of law and creates a precedent for a power grab by the executive branch. Congress needs to reassert it's authority by cutting off federal funds to pay for the policy change, consider legal action through the Judiciary and in the extreme, consider articles of impeachment.

America is a nation of laws with the constitution as the foundation of our republic. While other President's may have pushed the realm of federal power, this President has crossed the line. The President's refusal to enforce the nation's immigration laws is consistent with his philosophy to fundementally transform America. Instead of bringing the hope of jobs and positive change, the President has given hope to those who are here illegally, those who seek open borders and the promise of jobs to illegal aliens at the expense of Americans. Earth to President Obama, put Americans first and by the way, follow the constitution.
